Terms of Sale & Use

These terms apply when you order from Pretty Baked or use this website. Placing an order means you accept them, so please have a read — especially the parts about deposits, cancellations and allergens.

1. Who you are dealing with

Pretty Baked is a small custom bakery operating in Grande Prairie, Alberta, Canada. You can reach us at:

"We", "us" and "our" mean Pretty Baked. "You" means the person placing an order or using this site.

2. Placing an order

  • An order you submit here is a request, not a confirmed booking. Your order is only accepted once we confirm it with you by email or message.
  • We take a limited number of orders each week and may decline an order or a date we cannot bake well.
  • Most orders need at least 48 hours' notice. Larger and custom pieces usually need considerably more.
  • Please check the details on your confirmation — flavours, sizes, spelling on the cake, colours, date and time. We bake what the confirmation says.
  • You must be old enough to enter a contract in Alberta to place an order.

3. Prices, taxes and payment

  • All prices are in Canadian dollars. Taxes, where they apply, are shown on your order and invoice.
  • Prices on the site can change, but the price we confirm for your order is the price you pay, unless you later change the order.
  • Depending on what you are ordering, we accept payment by card online, e-transfer, or cash at pickup. Card payments are handled by Stripe — we never see or store your full card number.
  • Quotes for custom work are valid for the period stated on the quote.
  • Unpaid balances are due before or at pickup unless we have agreed otherwise in writing.

4. Deposits

Some orders — custom cakes, large orders and event bookings — need a deposit to hold your date. The amount is shown on your quote or invoice before you pay it.

Deposits are non-refundable. Once we hold your date we turn away other work for it, and we buy ingredients and supplies for your order ahead of time.

The deposit comes off your final balance.

5. Changing an order

We will do our best to accommodate changes requested more than 7 days before your pickup date. Inside 7 days, ingredients are bought and the work is often already under way, so changes may not be possible. Any change that increases the cost will be quoted to you before we make it.

6. Cancellations and refunds

  • Cancel more than 7 days before your pickup date and we will refund anything you have paid beyond the deposit.
  • Cancel 7 days or less before your pickup date and no refund is available, including any balance already paid. By then the date is held, the ingredients are bought and the baking is scheduled.
  • Deposits are not refunded in either case (see section 4).
  • If we ever have to cancel your order — illness, equipment failure, something outside our control — you get a full refund of everything you have paid us, including the deposit. That refund is the limit of what we owe you for a cancellation on our side.
  • Refunds go back the way you paid, and usually take 5–10 business days to appear.

7. Pickup, and orders that are not collected

  • Unless we have agreed to deliver, all orders are pickup only, at the address and time window on your confirmation.
  • Once your order is picked up, responsibility for it — how it is carried, transported and stored — passes to you. Cakes are fragile and heat-sensitive; carry them flat, keep them cool, and never on a car seat or in a hot trunk.
  • If you send someone else to collect your order, they are collecting it on your behalf and the same applies.
  • If your order is not collected within 24 hours of the agreed time and we have not heard from you, we may dispose of it. No refund is available for an order that is not collected.
  • Where we do deliver, we will confirm a time window with you. Someone needs to be there to receive the order, and delivery fees are shown before you pay.

8. If something is wrong with your order

Please tell us before you leave with your order, or as soon as you reasonably can, and we will do what we can to put it right. Photos help.

Because everything is made fresh to order and perishable, we do not offer refunds on orders that have been picked up. Nothing here takes away the rights you have under Alberta's consumer protection laws — those rights apply no matter what this page says.

Small variations in shade, texture and finish are part of handmade work. Photos on this site and on our social media show past work; your order will be similar in style but not identical.

9. Allergies and food safety

Our kitchen handles wheat, milk, eggs, soy, tree nuts, peanuts and other allergens. We cannot guarantee that any product is free from any allergen, and we cannot make allergen-free food to a medical standard.

  • Tell us about allergies and dietary needs when you order. We will tell you honestly whether we can safely bake for you — sometimes the answer is no.
  • Any dietary labels on the menu describe the recipe, not the kitchen. Cross-contact is possible.
  • Some decorations are not food: dowels, supports, wires, picks, ribbon, toppers and fresh or artificial flowers. Remove them before serving.
  • Fresh flowers, when used, are handled as decoration only and are not certified food-safe unless we have told you otherwise in writing.
  • Follow any storage and serving instructions we give you. Most of what we bake is at its best the day it is picked up.

10. Designs, photos and other people's artwork

  • When you send us an inspiration photo, you confirm you have the right to share it with us. We use it as inspiration only — we will not copy another baker's work outright.
  • We cannot reproduce copyrighted or trademarked characters, logos or artwork without permission from the owner. If you ask for one, we may decline or offer something in the same spirit.
  • We may photograph finished orders and share them on this site and our social media. Tell us if you would rather we did not, and we will not.
  • The design work we create for you stays ours; you are buying the cake, not exclusive rights to the design.

11. Your account and this website

  • If you create an account, keep your password to yourself and keep your details accurate. You are responsible for what happens under your account.
  • Reviews and messages you submit must be honest and your own. We may publish, edit for length, decline or remove them.
  • Do not misuse this site: no scraping, no attempts to break into it, no false orders, and nothing unlawful.
  • The text, photos, recipes, branding and design on this site belong to us and may not be copied or reused commercially without permission.
  • We keep the site running as best we can, but it is provided as-is. We do not promise it will always be available or error-free.

12. Emails we send you

We send emails about your order — confirmations, invoices, receipts, pickup reminders. These are part of doing business with you.

We only send promotional email if you have agreed to receive it, and every one of those has an unsubscribe link. You can opt out at any time and we will stop. This follows Canada's anti-spam legislation (CASL).

13. Our responsibility

If something goes wrong and we are at fault, the most we will owe you is the amount you paid us for the order in question. We are not responsible for indirect or knock-on losses — for example the cost of an event, lost profit, or disappointment.

None of this limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or under Alberta's Consumer Protection Act and Sale of Goods Act.

14. Your cancellation rights for online orders in Alberta

Alberta's Consumer Protection Act and its Internet Sales Contract Regulation give you rights when you buy online. In particular, you may cancel an internet sales contract:

  • within 7 days of receiving a copy of the contract, if we did not give you the required information before you ordered;
  • within 30 days of entering into the contract, if we did not give you a copy of it; and
  • if we do not deliver or make your order available within 30 days of the date promised.

To cancel under these rules, contact us using the details in section 1 and say clearly that you are cancelling. These rights sit on top of anything else on this page.

15. Changes, and the law that applies

  • We may update these terms. The version on this page when you place your order is the one that applies to that order.
  • These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, and the courts of Alberta will deal with any dispute.
  • If any part of these terms turns out to be unenforceable, the rest still stands.
